OlaRemote Terms of Use

These Terms of Use ("Terms") apply to OlaRemote, a television remote-control application for Android, including its updates and associated features ("OlaRemote" or the "App").

OlaRemote is developed by AFOLAOLA, Global Digital Solutions, a sole proprietorship operated by Olasunkanmi Oladele ("AFOLAOLA", "we", "us" or "our").

By downloading, installing or using OlaRemote, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not install or use the App.

Nothing in these Terms removes rights or protections that applicable law does not allow us to exclude.

1. About OlaRemote

OlaRemote is designed to let you control compatible televisions using supported Smart TV network connections or a compatible phone's built-in infrared transmitter.

The App is free to use and does not require an AFOLAOLA account for its remote-control functionality. You must be 13 or older to use it.

OlaRemote is not compatible with every television, phone or operating-system version. Available features depend on the devices, software, network configuration and supported control methods involved.

These Terms are the whole agreement between you and AFOLAOLA about the App.

2. Compatibility and supported devices

Compatibility depends on the television model, its software and settings, your Android device, your local network and the control method used.

Smart TV control

OlaRemote is designed to control Samsung Smart TVs that use the Tizen operating system, LG TVs that use webOS, Vizio SmartCast TVs, Android TV and Google TV devices (which includes many televisions sold under other brands), and Roku devices and Roku TVs, using local network communication. These integrations are in beta. Actual compatibility and operation depend on the television model and software version, and the released version of the App.

Other television platforms are not represented as supported unless AFOLAOLA expressly identifies them in the App or its published compatibility information.

Smart TV control generally requires your phone and television to be connected to the same suitable local network. The television may need to be powered on and configured to permit control from compatible devices.

Infrared control

Infrared control is available only where the phone has a compatible built-in infrared transmitter and the App supports the relevant code set.

External infrared accessories are not supported unless AFOLAOLA expressly announces and verifies compatibility.

Infrared code sets may not work with every model of a particular brand. The App may not be able to confirm whether a signal was received or whether a requested action occurred.

Feature limitations

Some buttons may be unavailable, behave differently or fail to produce the expected result. Power-control behaviour can vary by television and supported command.

We do not guarantee compatibility with any specific television or phone unless we expressly provide a separate, applicable guarantee.

3. Free use

OlaRemote is provided free of charge. The current version has no paid subscription, no in-app purchases, no AFOLAOLA account and no advertising.

If we introduce optional paid features or other commercial arrangements in the future, we will clearly disclose the applicable pricing and conditions before you purchase or agree to them.

If a paid feature is ever added, you will see its price and any refund or cancellation terms before you pay, and your statutory rights as a consumer will not be reduced. Nothing in this section limits rights you may have under applicable consumer law.

4. Your responsibilities

You may use OlaRemote only for lawful purposes and only to control devices and networks you own or are authorised to use.

You agree not to:

• Access or control a television, device or network without permission.
• Bypass security controls, authentication or authorisation requirements.
• Interfere with another person's device, network or use of a service.
• Use the App in violation of applicable law or a third-party platform's lawful requirements.
• Reverse engineer, modify, redistribute or commercially exploit the App except where permitted by applicable law, a separate written permission or an applicable third-party licence.
• Use the App in a way that compromises device or network security.

You are responsible for checking the device you have selected before sending commands and for understanding the effects of changes you make to your television's settings.

Do not rely on OlaRemote for emergency functions, safety-critical operations or any purpose where a failed, delayed or unintended command could cause harm.

5. Third-party devices and services

OlaRemote may communicate with televisions and devices made or operated by third parties. Those manufacturers and platform providers control their own products, interfaces, software, policies and services.

Their terms, technical changes, security settings or restrictions may affect the availability or operation of OlaRemote. We may be unable to maintain compatibility if a third party changes or discontinues an interface or imposes a restriction that applies to our use.

OlaRemote is an independent AFOLAOLA product. Unless we expressly state otherwise in a verified announcement, it is not affiliated with, sponsored by or endorsed by Roku, Samsung, LG, Sony or any other television manufacturer or platform provider.

Third-party names and marks are used only in plain text to identify relevant products or compatibility. Their use does not imply approval or endorsement. Third-party trademarks belong to their respective owners.

Nothing in these Terms represents that a third-party platform has approved OlaRemote. Applicable platform requirements must be respected. Whether OlaRemote may be distributed for control of Roku, Samsung, LG, Vizio or Android TV and Google TV televisions has not been confirmed with those companies, and AFOLAOLA may restrict or remove support for a platform if its owner objects.

6. Privacy

Your use of OlaRemote is also governed by the OlaRemote Privacy Notice, available at https://remote.afolaola.com/privacy.

The Privacy Notice explains the App's local storage, network communications, permissions and handling of information.

Please review it before using the App. If the App's data practices materially change, we may update the Privacy Notice and provide additional notice where required by law.

7. Intellectual property

OlaRemote, including its software, original design, interface, documentation, branding and associated materials, is owned by AFOLAOLA or its respective licensors, except for third-party materials subject to separate rights or licences.

Subject to these Terms and applicable law, AFOLAOLA grants you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use OlaRemote for its intended purpose.

Unless applicable law or a separate licence permits otherwise, you may not:

• Copy, modify, adapt or create derivative works from the App.
• Distribute, sublicense, rent, sell or commercially exploit the App.
• Remove or alter copyright, attribution or proprietary notices.
• Use AFOLAOLA's name, logo or branding in a way that suggests endorsement or affiliation without permission.

These restrictions do not override rights that applicable law grants you, including rights that cannot legally be excluded.

Third-party components remain subject to their respective licences and notices, which are available on request at legal@afolaola.com. Imported infrared files remain subject to any rights and licence conditions that apply to those files. You are responsible for ensuring you have the necessary rights to import and use such material.

8. Updates and changes

We may release updates to improve performance, security, compatibility or functionality. Updates may add, change, limit or remove features, including support for particular devices or platforms.

Some updates may be necessary to maintain compatibility with Android or a third-party device. We cannot guarantee that every older version will continue to operate indefinitely.

Where reasonably practicable, we will provide notice of material changes that significantly affect the App or its use. Notices and updates remain subject to applicable law and third-party distribution requirements.

9. Availability and discontinuation

We aim to make OlaRemote useful and reliable, but we do not guarantee that the App will always be available, uninterrupted, error-free or compatible with every supported device configuration.

We may suspend, restrict or discontinue the App or a feature where reasonably necessary, including for security, technical, legal, operational or third-party platform reasons.

Where practicable, we will give reasonable notice of a planned discontinuation. An urgent security issue, a third-party platform change or another circumstance outside our reasonable control may require action without advance notice.

10. Warranties

To the fullest extent permitted by applicable law, OlaRemote is provided on an "as is" and "as available" basis.

We do not promise that every command will be received, that every feature will work on every device, or that the App will always be uninterrupted or error-free.

Some jurisdictions provide mandatory warranties, guarantees or consumer rights that cannot be excluded or restricted by contract. Nothing in these Terms excludes, limits or modifies any such right, guarantee, remedy or liability where doing so would be unlawful.

Where permitted by law, and subject to the preceding paragraph, AFOLAOLA excludes implied warranties or conditions to the extent they may lawfully be excluded.

11. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the law applicable to you.

To the fullest extent permitted by that law, AFOLAOLA will not be liable for indirect, incidental, special or consequential losses arising from your use of, or inability to use, OlaRemote.

Subject to applicable law, AFOLAOLA is not responsible for losses caused by device incompatibility, your network configuration, television settings, third-party platform changes, unauthorised use of your device or commands that do not produce the expected result.

You remain responsible for using the App appropriately and checking the television or device before sending commands.

Because the App is free, AFOLAOLA's liability to you for any claim relating to the App is limited, to the fullest extent the law allows, to the amount you paid for it (which is nothing). Nothing in this section removes mandatory consumer protections or any liability that cannot legally be limited.

12. Suspension and termination

You may stop using OlaRemote at any time by uninstalling it.

If you materially breach these Terms, we may restrict or terminate your permission to use the App to the extent reasonably necessary and permitted by applicable law.

Ending your use of the App does not remove rights or obligations that arose before termination or provisions that, by their nature, are intended to continue to apply.

13. Changes to these Terms

We may update these Terms to reflect changes to the App, our practices, third-party requirements or applicable law.

The latest version will be published at https://remote.afolaola.com/terms.

We will update the "Last updated" date when the Terms are revised and provide additional notice of material changes where required by law. Where applicable law requires renewed consent, we will seek that consent before applying the relevant changes.

Your rights under applicable law are not reduced merely because these Terms are updated.

14. Governing law and disputes

OlaRemote is used in many countries, and no single law applies to everyone. These Terms therefore do not choose one country's law for every user. The law that applies to you, including the consumer-protection law of the place where you live, applies to the extent it cannot be excluded by contract.

If you have a problem, please email support@afolaola.com or legal@afolaola.com first. We will try to resolve it with you informally and promptly. If it cannot be resolved, either of us may take the matter to a court or authority that has jurisdiction under the law that applies.

Nothing in these Terms displaces mandatory consumer protections, statutory rights or other legal requirements that apply regardless of a contractual choice of law or forum.
